DUI With Child Passenger in Phoenix

Arrested on Aggravated DUI Charges? Consult Our Firm Now!

In Arizona, it is considered an aggravated DUI to drive under the influence of alcohol while a person under fifteen years old is in the vehicle according to the Arizona Revised Statutes § 28-1383(A)(3). DUI with a child passenger is just one of several circumstances that can lead to an aggravated DUI charge, though; DUI with a suspended license and a third DUI in 7 years, for example, can also result in an aggravated charge.

There are two ways a person can be charged with aggravated DUI involving a child passenger:

  • Driving with a blood alcohol content of .08 percent or higher with a child passenger (§ 28-1381)
  • Driving with a blood alcohol content of .15 percent or higher (extreme DUI) OR .20 or higher (super extreme DUI) with a child passenger (§ 28-1382)

Penalties for DUI with a Passenger Under 15
